【第一步】农用地转用、征用土地,必须符合土地利用总体规划、城市建设总体规划和土地利用年度计划。因此,用地单位在初步选定某农用地为建设用地后,应首先向国土资源局、建设部门、规划部门咨询是否符合该农用地的各项规划。

规划必须符合原国家土地管理局发布的《土地利用总体规划编制审批规定》(《国家土地管理局令》第七号)的要求。

如该建设项目列入国家国土资源局编写的《限制供地项目目录》,则地方人民政府批准提供建设用地前,须先取得国土资源部许可,再履行批准手续。

如该建设项目列入国家国土资源局编写的《禁止供地项目目录》,则在禁止期限内,土地行政主管部门不受理其建设项目用地报件,各级人民政府也不批准提供建设用地。

【第二步】确认该农用地可以用于建设,再根据建设部门的要求,进行和编制建设项目可行性论证,向建设部门提交用地申请,建设部门审查符合的,颁发建设项目的《选址意见书》。用地单位应按规定缴纳选址规费。

其中,农用地转用和土地征收批准文件有效期两年。农用地转用或土地征收经依法批准后,市、县两年内未用地或未实施征地补偿安置方案的,有关批准文件自动失效。

【第三步】用地单位持该《选址意见书》向同级国土资源局提出用地预审申请,由该国土资源局核发《建设项目用地预审报告书》。

建设项目用地预审文件有效期为两年,自批准之日起计算。已经预审的项目,如需对土地用途、建设项目选址等进行重大调整的,应当重新申请预审。

建设用地单位申请预审,应当提交下列材料: 1.建设项目用地预审申请表(该表由国土资源部统一规定); 2.预审的申请报告,内容包括:拟建设项目基本情况、拟选址情况、拟用地总规模和拟用地类型、补充耕地初步方案; 3.需审批的建设项目还应提供项目建议书批复文件和项目可行性研究报告。项目建议书批复与项目可行性研究报告合一的,只提供项目可行性研究报告。

如建设项目涉密军事项目或是国务院批准的特殊建设项目用地的,建设用地单位可直接向国土资源部提出预审申请。

国土资源局在自受理预审申请或者收到转报材料之日起二十日内,完成审查工作,并出具预审意见。二十日内不能出具预审意见的,经负责预审的国土资源局负责人批准,可以延长十日。

【第四步】用地单位凭《建设项目用地预审报告书》向建设部门、环保局等办理立项、规划、环保许可等手续,并缴纳各项审批费用;

环境保护部门根据《中华人民共和国环境保护法》和(86)国环字第003号《建设项目环境保护管理办法》对建设项目进行审批。

某些建设项目,还需要报劳动行政部门依据《建设项目(工程)劳动安全卫生预评价管理办法》予以审批。

【第五步】用地单位再持以上审批文件,向原预审的国土资源局提出项目用地的正式申请。

【第六步】国土资源局根据土地利用总体规划、城市建设总体规划和土地利用年度计划,拟定农用地转用方案、补充耕地方案、征地方案和供地方案,分不同类型,经各级人民政府审批。

If the construction project is included in the "List of Restricted Land Supply Projects" compiled by the State Administration of Land and Resources, the local people's government must obtain permission from the Ministry of Land and Resources before approving the provision of construction land, and then go through the approval procedures.

If the construction project is included in the "List of Prohibited Land Supply Projects" compiled by the State Administration of Land and Resources, the land administrative department will not accept the application of land for construction projects within the prohibited period, and the people's governments at all levels will not approve the provision of construction land.

[Step 2] Confirm that the agricultural land can be used for construction, and then conduct and compile the feasibility demonstration of the construction project according to the requirements of the construction department, submit the land application to the construction department, and the construction department will issue the "site selection of the construction project" Opinions. The land user shall pay the site selection fees as required.

Among them, the approval documents for agricultural land conversion and land acquisition are valid for two years. After the conversion of agricultural land or land acquisition is approved according to law, if the city or county does not use the land within two years or fails to implement the land acquisition compensation and resettlement plan, the relevant approval documents will automatically become invalid.

[Step 3] The land user shall submit an application for pre-examination of land use to the Bureau of Land and Resources at the same level with the "Site Selection Opinion", and the Bureau of Land and Resources will issue the "Pre-examination Report on Land Use for Construction Projects".

The validity period of the pre-examination documents for construction project land is two years, calculated from the date of approval. For projects that have been pre-reviewed, if major adjustments are required to land use, construction project site selection, etc., they should reapply for pre-review.

The construction land unit applying for pre-examination shall submit the following materials: 1. Application form for pre-examination of construction project land (this form is uniformly stipulated by the Ministry of Land and Resources); 2. Pre-examination application report, including: basic information of the proposed construction project and proposed site selection , The total scale of the planned land use, the type of the planned land use, and the preliminary plan for supplementary arable land; 3. For construction projects that need to be approved, a project proposal approval document and a project feasibility study report should also be provided. If the project proposal approval is combined with the project feasibility study report, only the project feasibility study report will be provided.

If the construction project involves secret military projects or special construction project land approved by the State Council, the construction land unit can directly apply to the Ministry of Land and Resources for pre-review.

The Bureau of Land and Resources shall complete the review work and issue a pre-review opinion within 20 days from the date of accepting the pre-review application or receiving the forwarding materials. If the pre-review opinion cannot be issued within 20 days, it may be extended for ten days with the approval of the person in charge of the Bureau of Land and Resources.

[Step 4] With the "Pre-examination Report on Land Use for Construction Projects", the land user shall go through the procedures of project initiation, planning, environmental protection permits, etc. to the construction department, environmental protection bureau, etc., and pay various approval fees;

The environmental protection department approves construction projects in accordance with the "Environmental Protection Law of the People's Republic of China" and (86) Guohuanzi No. 003 "Administrative Measures for Environmental Protection of Construction Projects".

Certain construction projects also need to be reported to the labor administrative department for approval in accordance with the "Construction Project (Engineering) Labor Safety and Health Pre-evaluation Management Measures".

[Step 5] The land user shall hold the above approval documents and submit a formal application for project land to the original pre-reviewed Bureau of Land and Resources.

[Step 6] According to the overall land use plan, the overall urban construction plan, and the annual land use plan, the Bureau of Land and Resources draws up plans for conversion of agricultural land, plans for supplementary farmland, plans for land acquisition and plans for land supply.
